Justice of Child Victim after fighting officlal apathy and ineptitude

Making sure that every complaint of child abuse reaching its logical conclusion is not an easy task. On 13th October 2010, we were able to get justice against a perpetrator after 3, 1/2 years of patient and persistent fight for justice. The 9 year old child victim of sexual abuse, experienced the worst when the Lady Inspector of Police refused to file an FIR even after coming to know that the child was subjected to sexual abuse and the child's complaint of vaginal swelling and pain. After refusing for 7 days without registering a complaint and not sending the child for medical examination, the matter was reported to Karunalaya by the parents. Immediate action was taken to insist for registration of a case which was refused by the police.

A case was filed at the Madras High Court with the help of Human Rights Lawyer Ms. Geetha, seeking a direction for filing the FIR and to transfer the case to CBCID. Taking cognizence of the case, the Hon'ble court ordered CBCID to register the complaint after passing stricture to the local police for not registering the complaint, and transfered the case to CBCID. The accused was arrested immediately after the High court order and remanded in prison. The parents of the child were threated by the accused to withdraw the case at every stage of the trial. Karunalaya staff too were threated for taking up the matter. After the trial proceedings about 3 and half years, the trial court gave the verdict on 13th October 2010 sentencing the accused for 7 years Rigorous Imprisonment and a fine of Rs. 2,750/-.

At last justice has been done, although not over yet, as he may appeal to the High court. We would like to share this experience with you, that we may take up issues strongly, particularly when the officials refuse to do justice for what ever reason.
